DESIGN REPRODUCTION You are my client. And while I have many clients, there is only one you. I want to make sure that your designs stay yours.

The designer retains personal rights to use the completed project and any preliminary designs for the purpose of design competitions, future publications on design, educational purposes and the marketing of the designer’s business. Where applicable the client will be given any necessary credit for usage of the project elements. Designer agrees that the client’s work is unique to the client and the specific design will not be used in other clients projects.

REJECTION/CANCELLATION OF PROJECT Life happens. Clients cancel. Projects fall to the wayside. But if the work has been done, I would like to get paid so that I can keep doing what I do.

The client shall not unreasonably withhold acceptance of, or payment for the project. If, prior to completion of the project, the client observes any nonconformance with the design plan, the designer must be promptly notified, allowing for necessary corrections. Rejection of the completed project(s) or cancellation during its execution will result in forfeiture of deposit and billing for all additional labor or expenses to date. All elements of the project must then be returned to the designer. Any usage by the client of those design elements will result in appropriate legal action. Client shall bear all costs, expenses, and reasonable attorney’s fees in any action brought to recover payment under this contract or in which Jesse Gibbs may become a party by reason of this contract.

The prices to be emailed specific to the project, specifications and conditions are hereby accepted. The designer is authorized to execute the requested projects as outlined by Client contact. Payment will be made as proposed below. Meetings are charged out as one (1) hour and mileage is charged at $0.52 a mile from my home office.

PROJECT ESTIMATES Down to the nuts and bolts of your project.

Project estimates are valid for 90 days from the date of estimate (via email). Project may be reestimated if, upon receipt of all project elements, the designer determines the scope of the project has been altered dramatically from the originally agreed upon concept. Printing fees will be estimated separately and payment arrangements made between designer, client and printer. There is no guarantee that printing times will match with your timelines, so please take that into account when requesting a project.

Believe it or not, it's super helpful for me to hear things that you love about my design; it helps me understand what you like, what you'd like to keep seeing and ways that I can showcase you to your clients.
HOW IT WORKS: Start with a kindness or a compliment, follow it up with a critique or a directive (i.e., "I love the color yellow, but I'm not a fan of Minions....") and then close up the sandwich with another compliment! ("...but I am a huge fan of sunflowers!")
It's not all about patting your designer on the back (although designers are famously in need of pats. And chocolate.)

DEDICATED EMAIL THREADS: Subject Line = Property Address/Project
COLLATERAL: What am I designing for you? Am I designing a brochure? A website? A giant rubber ducky with your logo on it? Whatever it is, make sure that's in the email too.
DETAILS: Anything you can get me about the property! Previous listing, address, beds, baths, sf, previous listing and anything else that you think I could use.
PHOTOS: I’m a visual person. 😉 Also, it's really hard to write about a property that you've never seen. Shoot me the link to the photos as soon as you can.
DUE DATE: When are you hoping to have this collateral in your hands?

48 HOURS: I ask for a 48 hour turn around for your first draft then I and work to beat it. The 48 hours starts AFTER I receive ALL of information that I need to move forward.
PRINTING: Do you have a preferred printer? Am I finding the printer for you? Do you want to use one of mine? (Please note, if I'm researching a new printer for you, there is a small upcharge for my time.)
APPROVAL: I will always ask for your approval in writing. After the project is approved by you, I am no longer responsible for the product.
I'm here to help you, but the more organized that YOU are, the more on top of things I can be for you.

It happens a lot; a four page website needs three extra pages, and a market report and also five galleries and a gold star. Which is totally fine - I'm here to help! But, when a project scope expands beyond my initial quote, the price will change. I'll do my best to keep you aware of the price changing based on your requests, however your request does imply to me that you're willing to pay for added scope. My goal is that I never surprise you with a bill, but please remember that I do need to get paid for the work that I do! If you have any questions about how a request might change the cost of a project, please don't hesitate to ask.

90 DAY ADDENDUM or "holy crap how did I get so busy?"

This is for BOTH of us! Heaven knows I get busy with oncoming listings during the busy season and so do you! I will keep your project on my plate for 90 days (unless otherwise specified) but any project that's been going on for more than 90 days will be subject to $75 Parking Fee and the account will be closed out until we're ready to restart - (see Scope Creep)

PAYMENT SCHEDULE "Show me the money!" You'll receive an email invoice through Square and you'll be able to pay your bill online, completely securely. Also, smiles, tips , thank you's and chocolates are always acceptable.

A deposit in an amount equal to 50% of the total estimated cost is requested prior to execution of any project estimate over $500. Payment in full or the remaining balance is to be paid upon delivery of the completed project. Payment in full or the remaining balance is to be paid 7 days from receipt of the final invoice for the completed project. A finance charge of 3% per week (repeated every 7 days) until payment in full on all overdue balances.
